1. Who is responsible for the ditch maintenance adjoining my property?

The adjacent property owner is responsible for the maintenance of the ditch. This means keeping the ditches clear and free from trash and obstructions so water is able to move through freely. This includes ditches, French drains, and driveway culverts. (City Code 13-1-1: Obstructions, Accumulations)

2. I am only renting a property adjoining a ditch, do I still have to maintain it?

Yes. The individual who is occupying the premises is responsible of the ditch, French drain, or driveway culvert maintenance. (City Code 13-1-1: Obstructions, Accumulations)

3. What do I do to get a drainage problem fixed that is not related to a ditch?

To request drainage maintenance, please submit request on Bixby Connect. City drainage maintenance is limited to flood control and prevention to City Infrastructure on the Right of Way. Most creeks are located on private property and are owned by the adjoining home or property owners. As a result, vegetation and erosion control is the responsibility of the individual property owner. 4. Is the City responsible for the mowing and tree maintenance adjacent to the Right-of-Way by my business or property?

The business/property owner is responsible for all mowing and tree maintenance adjacent to the Right-of-Way. This includes trimming of the trees and shrubs, as well as, removing any dead or dying trees or shrubs. Furthermore, the owner of such premises must keep an unobstructed, convenient passage and travel along streets, sidewalks, and alleys adjacent to the Right-of-Way. 5. Does the City repair residential sidewalks?

It is the duty of the occupant of any lot or piece of ground abutting upon any street to keep the sidewalk or gutter clean and to remove all materials, snow or ice, trash, weeds, refuse, rubbish, or hazards of any kind, and to keep the sidewalk and gutter in good repair. If there is no such occupant other than the owner, it is the duty of the owner to do the same. It is unlawful for the owner or occupant of property to permit the sidewalk or sidewalk area to become a hazard to persons using the sidewalk, or sidewalk area. 6. What's the difference between private and public streets?

A private street is usually located in a residential area such as a condominium development or gated community in which a homeowners' association maintains the grounds, streets, as well as storm sewers. The city cannot make repairs to private streets because they are not located on public property. However, the city does maintain the water supply and sanitary sewer. Even though you reside within the city limits, unless your street meets engineering criteria, it may not be maintained by the city. 7. Who do we call if we need a streetlight fixed?

The electric utility companies are responsible for replacing light bulbs on street lights.
